Terms of Use and Participation for the ESN Prize Draws “Designer Extra Creamy” and “ESN Coffee Lover”
Fitmart GmbH & Co KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter “we” or “us”) is running the following two prize draws via the ESN online shop (hereinafter each a “Prize Draw” and together the “Prize Draws”):
- Designer Extra Creamy Prize Draw (hereinafter “Extra Creamy Prize Draw”): 23/09/2026, 18:00 to 14/10/2026, 17:30
- ESN Coffee Lover Prize Draw (hereinafter “Coffee Lover Prize Draw”): 07/10/2026, 18:00 to 14/10/2026, 17:30
The period that applies to each Prize Draw is referred to below as the “Participation Period”. Both Prize Draws run in parallel from 07/10/2026, 18:00 to 14/10/2026, 17:30. You can enter both Prize Draws at the same time if you meet all the entry conditions for each one. Unless a distinction is made between the Prize Draws below, the rules apply to both.
1. Who can enter the Prize Draws?
All natural persons who are at least 18 years old at the time of entry and who reside in the following countries are eligible to enter:
- Extra Creamy Prize Draw: Germany, Austria, Switzerland, the Netherlands, France, Spain or the United Kingdom
- Coffee Lover Prize Draw: Germany, Austria, Switzerland, France or Spain
By entering, you accept these Terms of Use and Participation.
Employees of Fitmart GmbH & Co KG or of any company affiliated with us, as well as any other persons involved in the development and running of these promotions, are excluded from entering.
2. During which period can I enter the Prize Draws?
Extra Creamy Prize Draw: The Participation Period starts on 23/09/2026 at 18:00 and ends on 14/10/2026 at 17:30.
Coffee Lover Prize Draw: The Participation Period starts on 07/10/2026 at 18:00 and ends on 14/10/2026 at 17:30.
3. How do I enter?
To enter a Prize Draw, you must meet the following conditions for that Prize Draw within the relevant Participation Period:
Extra Creamy Prize Draw
- Product purchase: You must buy at least one ESN Designer Extra Creamy in the full-size 480 g variant (hereinafter “Extra Creamy Promotional Item”) in the ESN online shop.
- Opt-in: You must actively consent to entering the Extra Creamy Prize Draw during the ordering process (checkout).
Coffee Lover Prize Draw
- Product purchase: You must buy at least one ESN Designer Bar Dark Chocolate Mocha or at least one ESN Designer Bar Caramel Latte (hereinafter each and together “Coffee Lover Promotional Item”) in the ESN online shop.
- Opt-in: You must actively consent to entering the Coffee Lover Prize Draw during the ordering process (checkout).
Entering both Prize Draws
You can enter both Prize Draws at the same time if you meet all of the conditions above for each of them (purchase of the relevant promotional item and opt-in).
Within the Participation Period, you can enter each Prize Draw only once per person and order email address. If a person places several qualifying orders, their entry for the relevant Prize Draw is counted only once.
If an order is fully cancelled or returned under the statutory right of withdrawal, so that the promotional item for the relevant Prize Draw is no longer kept, your eligibility for that Prize Draw ends.
You can only enter in your own name. Provider-dependent costs (e.g. for your internet connection) may be incurred as a result.
All data collected is used solely to determine and deliver prizes. We process it in compliance with the applicable legal provisions.
4. When and how are the winners determined?
For both Prize Draws, the winners are drawn at random from all eligible entrants of the relevant Prize Draw once the standard withdrawal and return period has ended. Winners are notified by email within 14 days of the draw. The draw is carried out separately for each Prize Draw.
5. What prizes are there?
Fitmart GmbH & Co. KG is giving away the following prizes among all eligible entrants of the relevant Prize Draw:
Extra Creamy Prize Draw
1st prize (10 to be won): 1x Ninja Creami ice cream maker worth 269 €
2nd prize (100 to be won): 1x ESN Designer Extra Creamy Launch Box worth 83.70 € (pre-configured, cannot be modified)
In total, 110 prizes are therefore up for grabs in the Extra Creamy Prize Draw. Each person can win only one prize in the Extra Creamy Prize Draw.
Note on 1st prize (Ninja Creami): The model of the Ninja Creami that is currently available at the time of dispatch will be sent. The Prize Draw has no connection with SharkNinja Operating LLC or the Ninja brand and is not sponsored, endorsed or organised by them.
Note on 2nd prize (Extra Creamy Launch Box): The specific contents of the Launch Box are determined by the organiser and cannot be customised.
Coffee Lover Prize Draw
1st prize (3 to be won): 1x Ninja Luxe Café Pro coffee machine worth 749.99 €
2nd prize (10 to be won): 1x ESN Coffee Lover Box worth 161.60 € (pre-configured, cannot be modified)
In total, 13 prizes are therefore up for grabs in the Coffee Lover Prize Draw. Each person can win only one prize in the Coffee Lover Prize Draw.
Note on 1st prize (Ninja Luxe Café Pro coffee machine): The Prize Draw has no connection with SharkNinja Operating LLC or the Ninja brand and is not sponsored, endorsed or organised by them.
Note on 2nd prize (Coffee Lover Box): The specific contents of the Coffee Lover Box are determined by the organiser and cannot be customised. The Coffee Lover Box contains the following products:
- 2x ESN Coffee Bar (worth 30.90 € each)
- 2x ESN Flexpresso (worth 49.90 € each)
The physical prizes are sent by post to an address provided by the winners.
6. How is my data processed?
You can find information on data processing in our Privacy Policy.
We process the data only to run and administer the Prize Draws in accordance with Art. 6(1)(b) GDPR. The data provided in the context of the Prize Draws is deleted, subject to statutory retention obligations, once the purpose of processing no longer applies or the data is no longer required for that purpose.
You can withdraw your consent to enter the relevant Prize Draw at any time. You can do so by email to the contact address given in the Privacy Policy or via the opt-out link in any email we send. Withdrawing your consent ends your eligibility for the relevant Prize Draw.
7. Other provisions
Prizes cannot be paid out in cash. Prizes cannot be exchanged for other benefits or prizes. Prizes are not transferable. From the date the winner notification is sent, winners have two weeks to accept their prize by replying to the email from Fitmart GmbH & Co. KG and providing their postal address. If a winner fails to do so, or if it is not possible to inform a winner of their prize, the prize is forfeited and awarded to another entrant of the relevant Prize Draw following the procedure described above. The same applies if the prize cannot be delivered or is returned. Entrants are solely responsible for the accuracy and completeness of the contact details they provide.
Winners are themselves responsible for any tax due on their prize. If individual provisions of these terms of participation are or become invalid, the validity of the remaining terms is not affected. Legal recourse is excluded. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
8. Can I be excluded from the Prize Draws?
A breach of these terms of participation entitles us to exclude you from the Prize Draws. This applies in particular if false information is provided or the rights of third parties (e.g. personality rights / copyright) are infringed.
We may also exclude entrants who manipulate or attempt to manipulate the entry process and/or breach these terms of participation and/or otherwise try, in an unfair and/or improper way, to influence the Prize Draws or their administration, in particular by interfering with the software used. In these cases, prizes can also be revoked and reclaimed retroactively.
